Terms & Conditions

Please read the following terms &conditions carefully. By confirming the reservation, you certify that you have read, understand and comply to agree with all terms & conditions described bellows:

  1. Contract of Hire
    All bookings are accepted by Individual Bali Hospitality management and are subjected to these conditions which are deemed to have been accepted in full by the hirer and all persons in the party. Bookings can be made by post, email or through the websites and would be deemed to be accepted once payment is received by us.

    Individual Bali Hospitality management, hereinafter referred to as “The management”, acts merely as booking agents on behalf of the villa owners that is represents. The contract entered into is between the owner of the holiday accommodation and the holidaymaker, hereinafter referred to as “The hirer”. The contract is not effective until required payment has been received and confirmation has been sent to the hirer.
     
  2. Payments
    ​​A deposit of 50% of the rental amount must be received by the agency within two (3) working days after the relevant invoice and payment instructions have been given to the hirer. If a deposit is not received within this time, the booking will be cancelled.

    Final payment is required 45 days prior to arrival (60 days for Christmas/New Year bookings) or immediately if booking is made less than 45 days prior to arrival (or 60 days in the case of Christmas/New Year’s bookings).

    In the case of bookings made 45 days prior to arrival, full payment is required within two (3) working days, or on arrival, if less than two (3) working days, whichever comes first.

    ​All payments must be made in USD or in IDR. Payments options are:
    • Telex Transfer – All charges incurred for Telex Transfer transactions will be borne by the hirer.
    • Online Payment with Credit Card – Online payment is the simplest and quickest way to settle your bill. Following a link we provide on our invoice will take you to an online form where you will have to fill in your credit card details. Payment takes effect as soon as the system informs that the payment is approved. Subjected to 4% of credit card processing surcharge. Only Visa and Master Card accepted.
    • Payments by Traveler’s Cheques, other currencies or personal cheques, will not be accepted.
    • In the case of last minute bookings, where is it impractical or very difficult for the hirer to make a deposit by TT, we will accept cash (post 2007 and unmarked USD banknotes) on arrival.

    Be aware that security deposits are required, a deposit will be requested by the villa manager on arrival and will be refunded in full on the day of departure, unless damages/repairs need to be performed, in which case refunds will be made, less the cost of damages.

    Please also note that Indonesian banking regulation requires online transaction has to be made in Indonesian Rupiah. Therefore if you choose to pay by online payment, you will get your invoice pre-converted into Rupiah.

    Conversion to Rupiah does not apply to bank transfer especially in payment via bank transfer, in case you are aware that your payment may not reach our account in time, promptly notify us by sending (either emailed scan or fax) your transfer instruction receipt. Make sure that the receipt has bank’s authorization print-out.

    As soon as we receive the payment, we will issue a PAYMENT RECEIPT NOTICE, advising you that the villa is locked for your stay. It can be subject to further (final) payment.
     
  3. Cancellations
    If the reservation is cancelled 61 days or more prior to arrival (91 days for Christmas/ New Year bookings), deposits will be refunded in full less USD 500 OR 20% of monies received (whichever is greater).  Please note that if multiple villas are booked, a cancellation fee will be applied for each individual villa.

    Reservations cancelled less than 61 days prior to arrival are subject to a complete forfeiture of deposit to compensate the agency for the time and effort involved in making a booking and to compensate the owner for the loss of other potential bookings that have turned down once a booking has been confirmed.

    Notice of cancellation must be received by the agency in writing and Final payments are non-refundable. 
     
  4. Alternations and Cancellations by Us
    In the unlikely event that a villa becomes unavailable due to circumstances beyond our control, we will offer alternative period if possible, alternative accommodation if available, or a full refund of all payments you have made. Refund is limited only to the rental costs. We are not liable to cover costs that may incur related to your travel arrangement i.e. administration fee to reschedule your flight, etc.

    Alteration to booking period can only be accepted upon availability of the villa. If your new period falls in different season where higher price is applicable, you will have to pay the additional cost accordingly. If your new period falls in different season where rental price is lower, no refund will be paid. If your new period is longer than your initial period, you will have to pay the additional cost. If your new period is shorter than your initial period, no refund will be paid. In any cases a USD 50 administration fee per villa per booking is applicable and the new period will only be confirmed as soon as all payments related to the change are completed.
     
  5. Changes to Bookings
    A USD 50 administration fee per villa per booking will be applied to each change after a booking has been confirmed. Changes cannot necessarily be accommodated in all cases.
     
  6. Tax & Services
    At all hotels in Indonesia, a standard 10% Government Tax and a 5% Surcharge is levied. However, when renting the majority of private homes or villas, there are currently no taxes, surcharges, hidden costs, staff salaries, service fees, or management fees, outside or above the price quoted, unless otherwise stated. All are fully inclusive in the price.  Gratuities for household staff are encouraged and normal, but shall be left to hirer's discretion.
     
  7. Provisions and Staff
    All villas we represent have a minimum of two domestic household staff. All our properties are fully equipped with bed linens, towels, cooking utensils etc. Any defects and deficiencies must be reported within 24 hours of your arrival otherwise it will be assumed that everything is in order.
     
  8. Occupancy
    Upon confirming your booking you will be required to list all members of your group. Only those appear on the list may occupy the villa. In any cases the villa cannot be re-let or sublet to any other group/party or individual written agreement with us. Under no circumstances you are allowed to exceed maximum occupancy specified in the villa description without prior agreement in writing.

    Individual Bali Hospitality management reserve the right to refuse admittance to the villa if the hirer breaks this condition. In any circumstances animals are prohibited at all of our villas.
     
  9. Hirer’s Responsibility
    The hirer is responsible for taking all reasonable care of the property and its contents including all equipment, furniture, utensils, etc. The hirer shall ensure that no member of the party engages in any activity in or around the villa and swimming pool which may cause damage, offence to the neighbors, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behavior.
     
  10. Damage to Villa and Its Contents
    Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred due to negligence, willful damage or irresponsible behavior on the part of those occupying the villa or their guests. Such damage must be immediately reported to the villa manager, Individual Bali Hospitality Management or our representative. The cost of the replacement or damage must be paid for by the hirer prior to departure.
     
  11. Rights of Access
    Individual Bali Hospitality management, villa owner, villa manager, their representatives or their sub-contractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work.
     
  12. Liability
    Whilst the agency makes every effort to ensure that brochure descriptions are accurate and that properties meet its required standards, the Agency cannot accept responsibility for any alterations made to the property or its amenities, which are beyond its control.  Nor can it accept responsibility for any injury, sickness, loss, damage, additional expense or inconvenience, directly or indirectly caused by or arising out of the use or condition of the property and its appearances, plumbing, gas, electrical or otherwise, exceptional weather conditions or owner's negligence. Further, no responsibility is accepted for the personal belongings, car, and its contents of the hirer or any member of the party during the holiday.

    In addition, no responsibility will be accepted for dissatisfaction, loss or injury relating to bookings made through any third party vendor referred by the agency including but not limited to event co-ordinations, tour operators and other service providers.
     
  13. Villa Arrival and Departure Times
    The villa will be available for occupation from 2.00pm local time on the day of arrival and must be vacated by 12.00am on the day of departure.
     
  14. Keys, Directions and Local Contact Numbers
    Key to the villa will be held by villa manager or villa staffs. Locking the villa and taking the villa along when you leave is prohibited. Upon your arrival our representative welcoming you at the airport will give you details of persons you need to contact related to both issues with your stay at the villa or other things related to your holiday.
     
  15. Events and Parties
    The majority of villas have rules governing their usage for events and parties and oftentimes a surcharge is applicable, in addition to a local community or ‘Banjar’ fee. Normal bookings are for vacation purposes and special permissions must be obtained for functions where the number of people in attendance exceeds 150% of the capacity of the villa. Also clients should be aware that these are private villas located in residential neighborhoods and, as such, not all functions or events can necessarily be accommodated. Much depends on the vagaries of the neighborhood’s residents.

    Weddings and other events held at villas are becoming increasingly popular.  Please be aware that the majority of villa owners will not accept a booking involving a function without prior confirmation that a function coordinator has been employed.

    If you are planning to hold an event such as a wedding or any large congregation of people at your villa it would be best to bring this to the agency’s attention as soon as possible. The agency can recommend a suitable coordinator.
     
  16. Complaints
    If the hirer considers that he/she has cause for complaint concerning a property, the matter should first be taken up with the owner or villa manager.  If satisfaction cannot be obtained, the client should then report the matter at once to our office. Neither Individual Bali Hospitality management nor their representatives shall have any liability for any complaint submitted after the completion of the hire period.
     
  17. Building Work 
    In the event of building works taking place by local authorities, private developers or neighbors, it is important to note that we are not responsible for such work, are unable to stop such work taking place or unable to control the level of noise, neither can we be responsible for any building works that take place during a holiday.

    If we know the building work happen before your arrival, we will inform you immediately and help you to solve the problems.
     
  18. Force Majeure
    We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeure’. In these Terms and Conditions of Hire, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control.
     
  19. Law and Jurisdiction
    Individual Bali Hospitality management acts solely as an intermediary booking agent on behalf of the property owners. The rental contract is ultimately between the property owner and the hirer. Any disputes arising from the hire of the property will be resolved between the hirer and the owner. This agreement shall be governed by the laws of the Republic of Indonesia to which both parties expressly submit.
     
  20. Insurance
    The villa hire cost does not include any personal insurance cover of any kind. It is a condition of booking that insurance is taken out against cancellation and it is strongly recommended that personal accident and medical insurance is also taken out.

    We strongly recommend that you take out a comprehensive insurance to protect you and all those that accompany you for the full time of your visit against illness, injury, death, loss of baggage and personal items, cancellations and other travel contingencies. We also strongly recommend a health insurance that covers medical evacuation for emergencies.
